The applicant is seeking bail in CR No.I-82013 registered with Boisar Police Station, District Palghar under Section307,326,143,147,148, 323,504,506 of the I.P.C. There are in all eight accused-persons in thepresent crime, out of which role attributed to accused Fujail Khan and Hakim is different than the other accused persons. The learned counsel for the applicant submitted that the other three accused persons namely Jamil Mohd. Saddam Dildar and Jiju Khan have been released on bail by this court. He further submitted that the role attributed to the

2 /2 BA-877-15 present applicant is same and similar to that has been attributed to the other accused persons, who have been released on bail.
2) I have perused the orders passed in the case of Jamil Iqbal Khan, Mohd.Saddam Dildar Hussain and Jiju Khan and I find substance in the contention of the learned counsel for the applicant. In my opinion, the principle of parity applies to the present applicant also. In view of the above, the applicant has made out a case for releasing him on bail. Hence, the following order.
ORDER
a) Application is allowed.
b) The applicant be enlarged on bail on furnishing PR bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.
c) The applicant shall report to concerned police station on first Sunday of each month between 10.00 a.m. to 12.00 noon till the conclusion of trial.
d) The application is allowed in the aforesaid terms.
