The applicant has been convicted under section 302 r/w. 34 of Indian Penal Code. The applicant is now seeking bail. There are four eye witnesses in the present case, i.e., PW-1 Sakaram Sudam Karande, PW-2 Siddhesh Anil Redekar, PW-3 Rakesh Prakash Mhaske and PW-4 Prashant Prabhakar Dalvi. The eye-witnesses have stated that the applicant assaulted deceased Ashok with sword on the head. Deceased Ashok sustained 14 injuries. Looking to the evidence on record, this prayer of the applicant for bail is rejected. 3.

10.APPA570_2016.doc It is seen that the Appeal is of the year 2015. At present, hearing of appeals of the year 2009 are going on. Hence, it is not possible to expedite the hearing of the Appeal .
