The applicant has preferred Criminal Revision Application No.495 of 2015 challenging the judgment and order dated 28th September, 2015 passed by Additional Sessions Judge, Pune dismissing appeal and judgment and order dated 2nd September, 2014 passed by J.M.F.C. Khadki, Pune convicting the applicant for offences punishable under Sections 420, 467, 468 & 471 of Indian Penal Code and Section 11 of Maharashtra Scheduled Castes, Scheduled Tribes, De-Notified Tribes, (Vimukta Jatis) Nomadic Tribes, Other Backward Classes and Special Backward Category (Regulation of issuance and verification of) Caste Certificate Act, 2000.

The revision application has been admitted by this Court by order dated 28th October, 2015. The applicant had preferred an application for fixing the revision application for hearing. By order dated 4th August, 2016, it was directed that the Revision Application be placed for hearing and final disposal on 3rd October, 2016. Vide order dated 1st March, 2018, this Court had permitted the applicant to furnish paper book.

This application is preferred to dispense with filing of paper book as ordered by this Court vide order dated 1st March, 2018 with further directions to call for record and proceedings from the lower Court.

It is submitted that the applicant is senior citizen. He has undergone bypass surgery, angioplasty and had suffered paralysis attack. With a view to prepare paper book, the application was preferred for certificate copy of the record and proceedings before the Appellate Court. The copies were furnished him. Several pages were not legible. Hence, paper book could not be filed. The revision application is pending since long. Hence, in these circumstances, filing of paper book may be dispensed with and the record and proceedings be called from the lower Court and matter be heard on the basis of the record and proceedings.

Considering the aforesaid circumstances, following order is passed :-

ORDER

i.

Interim Application No. 2112 of 2022 is allowed and disposed of;

ii.

Filing of paper book is dispensed with.

iii.

Record and proceedings be submitted to this Court expeditiously.

iv.

On receipt of record and proceedings, the applicant may apply for expeditious hearing of Revision Application. (PRAKASH D. NAIK, J.)
