The Interim Application has been preferred for extension of Interim Stay granted by this Court in Writ Petition No.2449 of 2018 and 2450 of 2018. Vide order dated 7th November, 2019, the petition was admitted and stay was granted to the proceedings under challenge.

The learned Magistrate by order dated 31st March, 2022 has observed that in view of the Judgment of the Apex Court Asian Sunny Thote
(44)-(45)-IA-1662-2022.doc Resurfacing Road Agency V/s Central Bureau of Investigation. The stay has expired after period of six months from date of interim order.

Learned counsel for the respondent submit that the matter pertains to the complaint under the Negotiable Instruments Act. In view of the order dated 7th November, 2019, the entire proceeding before Trial Court are stayed. The Interim Relief may not be extended and the petition be fixed for hearing. 4.
Considering the fact that interim stay is in operation from 7th November, 2019, the stay is continue till further order. 5.
Both the petitions be listed for final hearing on the hearing board in the week commencing from 11th July, 2022. In the event the petition does not reach for hearing, the respondent is granted liberty to mention the matter for fixing it for hearing. 6.
Interim relief granted earlier shall continue to operate till the next date.
