The parties have produced the Consent Terms on record which are marked 'X' for identification. The Consent Terms are signed by the parties and their counsel. The parties admit the correctness of the contents thereof. The parties are represented by their counsel. 2.

The record discloses that there are three Claimants, out of which the Tribunal by the impugned Award has not granted any Mamta Kale

157-FA-1086-2019.doc compensation to the original Claimant No.3 (Respondent No.3). Hence, he is not a party to the Consent Terms. The learned counsel for the Respondents states that Respondent No.3 Mr. Dattatraya Mahadev Vachkal has not filed any Appeal.

In such circumstances, the Appeal is disposed of in terms of the Consent Terms with no order as to costs.

The Appellant shall be entitled to refund of Court Fees as per Rules. The statutory amount of compensation alongwith interest, if any, shall be made over to the Tribunal which shall pass appropriate orders for the payment of the compensation in proportion of the apportionment made by the Tribunal.

A decree be drawn accordingly.
