Learned Counsel for the applicants/accused and the respondent No.2, the contesting party, have tendered consent terms dated 5.12.2018, signed by the parties as also their respective advocates. Both the Counsel submit that the parties have settled the matter and the learned Counsel for the complainant/respondent No.2 submits that the complainant - Kunal Janardhan Naik does not want to proceed against the applicants/accused, as they have received the due amounts.

The consent terms are taken on record and marked 'Exhibit 1' for identification. The identity of the parties, who are present in the Court, is verified and confirmed by the Court Sheristedar. In view of the consent terms, the process issued in C.C. No.154/2015 on 22.1.2015 by the learned Metropolitan Magistrate, 7th Court, Bhoiwada u/s 138 r/w section 141 of the Negotiable Instruments Act as also the proceedings i.e., C.C. No.154/2015 are hereby quashed and set aside.
