DATE: DECEMBER 13, 2021 P.C.:- 1] Applicant was arrested on 15.09.2020 and came to be chargesheeted in C.R. No. 397 of 2020 registered with Vikhroli Police Station for the offence punishable under Sections 302, 307, 323, 504 and 506 of the IPC. Initially offence under Section 307 of IPC was registered.

2] Prosecution case is, deceased initially assaulted the Applicant and as such Applicant, in turn, gave repeated fist and kick blows to the deceased, resulting into his death.

3] I have perused the charge-sheet. There was previous enmity between the parties i.e. deceased and the Applicant. At the most, offence is punishable under Section 304 Part-II of the IPC. As such, Application stands allowed.

No. 397 of 2020 registered with Vikhroli Police Station for the offence punishable under Sections 302, 307, 323, 504 and 506 of the IPC on furnishing P. R. Bond in the sum of Rs. 25,000/- with one or more sureties in the like amount. Applicant shall neither directly or indirectly try to influence the witnesses nor tamper with the evidence. 5] Application is disposed of.
