By way of this application, the applicant one of the petitioner i.e. petitioner no.28- Ramesh Devji Patil, prayed for deletion of his name from the array of the petitions and further prayed for withdrawal of the petition and for vacating the order qua the applicant/petitioner no.28.

Learned counsel Mr. Kulkarni appearing for the applicant/petitioner no.28 invited our attention to the order passed by this Court dated 27th January 2020, wherein similar exercise was undertaken and vide order dated 27th January 2020, the application varsha

9.ia.17573-2022 and ors IAs.doc was allowed in terms of prayer clause (a) subject to direction that the applicant shall handover possession of the subject land to the respondents. Necessary amendment was permitted for carrying out within stipulated period 3.

In view of the ground raised in the application as well as earlier order passed by this Court dated 27th January 2020, the application is allowed in terms of prayer clause (a) subject to the applicant/ petitioner no.28 handing over possession of the subject land to the respondents within two week from today. The necessary amendment shall also be carried out within two weeks from today. 4.
