IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CRIMINAL APPELLATE JURISDICTION CRIMINAL APPLICATION NO.195 of 2015 Vinod Pandurang Pawar .. Applicant

Versus

Kishore Hiru Sawant and Anr .. Respondents --- Mr.Aditya Mehta i/b Negandhi Shah & Himaytullah for the applicant/appellant.

Mr.Kishore H. Sawant - respondent no.1 present in person. Mr.A.R.Patil, APP for the Respondent State.

--- CORAM : ABHAY M. THIPSAY, J.

DATED : 15th JANUARY, 2016 --- P.C. :

The learned counsel for the applicant submits that though the respondent was acquitted, and though leave to file the Appeal against acquittal has not so far been granted, the respondent has come forward to settle the matter, and that the parties have already settled their dispute amicably. He filed consent terms signed by the appellant and the respondent. Since the respondent is not represented by any Advocate, I have ascertained from him by putting questions to him that he understands the terms of the compromise and is settling the dispute without any influence or pressure. The consent terms are taken on record, and marked "X" for identification.

Tilak 2/3 (904)ALP-195-15 Since the dispute between the parties is settled, the learned counsel for the applicant seeks permission to withdraw the application.

Application is allowed to be withdrawn and stands dismissed as such.
