The applicant and the respondent married on 14.3.2009 at Pune. After marriage, they cohabited at Pandharpur which is 250 kms away from Pune. The applicant has given birth to a child who is now aged around 7 years and is residing with her at Pune. After the matrimonial dispute, the wife has shifted to Pune and is residing with her parents. She seeks transfer of Divorce Petition HMP No.25

2/3 of 2017 filed by the husband in the Court of Civil Judge, Senior Division,Pandharpur to the Court of Civil Judge, Senior Division, at Pune. The respondent has not filed any reply 3.

For the reasons afore-stated and relying on the judgment of SUMITI SINGH's case AIR 2002 SUPREME COURT 396 and in the light of the uncontroverted facts, the application is allowed in terms of prayer clause (a).

HMP No.25 of 2017 is transferred from the Court of Civil Judge, Senior Division, Pandharpur to the Court of Civil Judge, Senior Division, Pune.

The Superintendent, Court of Civil Judge, Senior Division, Pandharpur to transmit the record to the Court of Civil Judge, Senior Division, Pune at the earliest. 6.

Parties shall remain present in the Court of Civil Judge,
