The Advocate for the Petitioner has filed a leave note. Place the petition on 3rd April 2017 under the category of fresh matters. We make it clear that if what is stated by the learned APP is correct, unless the Petitioner surrenders, this petition cannot be heard on merits".

2/2 (29)wp-1762-15.doc Today, neither the petitioner nor his counsel are present. Learned APP makes a statement that petitioner has not surrendered, on the contrary, he is absconding. We are therefore not inclined to entertain this petition. The same is accordingly dismissed.
