The present C.R. is the result of the matrimonial discord between the husband and the wife, which resulted into invoking Sections 498A, 323, 504, 506 read with Section 34 of the IPC against the applicant husband and his relatives. 2.

The respective counsel state that they have settled the

2/3 16 ABA-1178.22.odt discord amongst themselves for the sake of their son and the consent terms under the signatures of the applicant and his wife inked in the presence of their respective counsel, dated 12/07/2022 are placed on record. The consent terms are taken on record and marked 'X' for identification.

It is also undertaken that the complainant shall withdraw the case once the charge-sheet is filed in the matter. 4.

In the wake of the above, the accusations faced by the applicant no longer survive as the husband and the wife are residing together and the applicant deserves his protection. Hence the following order:

ORDER

(a) In the event of arrest, the applicant - Jamaluddin Nooruddin Sayyed shall be released on bail in C.R. No.773 of 2021 registered with D.N. Nagar Police Station, District Mumbai on executing P.R. bond to the extent of Rs.25,000/- and furnishing one or two sureties of the like amount.

(b) The applicant shall not directly or indirectly make any inducement, threat or promise to any

3/3 16 ABA-1178.22.odt person acquainted with facts of case and shall not tamper with prosecution evidence.

(c) The applicant shall report to the D.N. Nagar Police Station, Dist. Mumbai as and when directed by the Investigating Officer.

The application is allowed in the aforestated terms. 6.
