The applicant is apprehending arrest in connection with notice dated 9th April 2021 issued by Kurla Police Station indicating that applicant should remain present before police station regarding inquiry in respect of appointment of contract labours. The applicant preferred application for anticipatory bail apprehending arrest. The said application was rejected by order dated 27th April 2021. 2.

It is pertinent to note that while the application was disposed of by the Sessions Judge, no FIR was registered against applicant. However, in view of notice received by the applicant, it was prayed that 72 hours notice prior to arrest be given to him. Learned Sessions Judge by order dated 27th April 2021 rejected the said application.

Contention of the applicant is that there is persistent apprehension of arrest and hence the applicant has moved this

2 of 2 30.ABA.1210.2021.doc application before this Court. It is contended that in the event respondent decides to register FIR and arrest the applicant, 72 hours advance notice in writing be given to the applicant. 4.

Learned APP submits that the FIR has not been registered. However, it is likely to be registered shortly. On instructions it is submitted that in the event concerned police station intends to arrest the applicant in respect to the subject complaint after registration of the FIR, 72 hours notice in writing would be given to the applicant. The statement is accepted. In view of the statement, the application is disposed of with direction that in the event the respondent Police Station intend to arrest applicant, 72 hours notice in writing be given to the applicant.
