This Application is taken out by the Non-Applicant in Marriage Petition A 69 of 2017 which is pending in the Court of the Family Court, Thane seeking transfer of the said proceedings to the Civil Court, Senior Division, Barshi.

After hearing learned counsel for the parties, for some time, I indicated my disinclination to transfer the proceedings, since such request is made fve years after the institution of the proceedings, which are at the stage of recording of the evidence of the Petitioner-husband, who has

However, considering the nature of the controversy, it would be in the interest of both the litigating parties that the proceedings are disposed of with utmost expediency.

While I am not inclined to direct transfer in exercise of powers under Section 24 of the Code of Civil Procedure, 1908 (for short 'CPC'), the learned Judge, Family Court, Thane is requested to dispose of the Marriage Petition A 69 of 2017 as expeditiously as possible and in any event, within the next three months.

The parties shall co-operate with the learned trial Court in expeditious disposal. No adjournment shall be granted unless just and exceptional case is made out. 6.

The Application is disposed of.
