1] On the last date, it was submitted by the learned counsel appearing for the petitioner that the documents at page 53 and 54, show that the petitioner had applied for regularisation.

2] Today, a compilation of documents is placed on record by the Advocate for the Municipal Corporation which is marked as 'X1' for identification. The documents disclose that in fact, the petitioner had applied for DP remarks and not for regularization. 3] Faced with this difficulty, learned counsel appearing for the petitioners seeks leave to withdraw the petition with liberty to apply for regularization in accordance with law. Accordingly, the petition is dismissed as withdrawn with liberty as prayed for. 4] All the contentions of all the parties are kept open. (M. S. SONAK, J.) (A.S.OKA, J.)
