1] This is an application for temporary bail on the ground that the of marriage of the daughter of the applicant is to be solemnized on 8th May 2017 at village Umbarde, Kalyan, District-Thane. The invitation card is attached at page No.5 to the application.

2] The learned APP on instructions submitted that the concerned Investigating Officer attached to Bazarpeth Police Station, Kalyan has verified the said fact and it is reported that the marriage of the daughter of the applicant will be solemnized on 8th May 2017, village Umbarde, Taluka Kalyan.

3] In view thereof, the applicant can be released on temporary bail from 6th May 2017 to 10th May 2017 (both days inclusive) in CR No.I-

2/2 BA.987-2017 237 of 2012 registered with Bazarpeth Police Station, Kalyan, District Thane.

Hence, the following Order:

(i) The applicant be released on temporary bail from 6th May 2017 to 10th May 2017 (both days inclusive) in CR No.I-237 of 2012 registered with Bazarpeth Police Station, Kalyan, District Thane on his furnishing PR bond of Rs.25,000/- and cash bail of Rs.25,000/-. The cash bail to be deposited before the Trial Court. The applicant shall be released after 9.00 a.m. on 6th May 2017 and shall surrender before the Jail Authority on or before 5.00 p.m. on 10th May 2017. (ii) After his surrender to the jail authority within stipulated period the applicant shall be entitled to refund of the cash bail amount. The concerned Authority/Court shall refund the cash bail amount to the applicant within 8 days from making such an application. (iii) The applicant when on bail shall not tamper with the evidence and/or influence the prosecution witnesses.
