1] By a reasoned Order dated 13th April 2018, the applicant was granted interim relief and was directed to attend the Investigating Office on stipulated dates, to cooperate in the process of investigation. 2] Heard the learned counsel for the applicant and the learned APP. Perused the record.
3] The record indicates that, the coaccused namely Sandeep Goenka, Ms. Shefali Tiwari, Ms. Megha Dodeja and Sachin who have been attributed with same and/or similar role as played by the present applicant 1/2
aba.742-2018.doc have been granted prearrest by this Court by its Order dated 19th April 2018. The applicant is similarly situated with those accused persons with similar allegations. Apart from the said fact, there are general allegations made in the first information report as far as the present applicant is concerned.
4] In view thereof, interim relief granted by Order dated 13th April 2018 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
5] Application is allowed in the aforesaid terms. 6] In view of Order passed in A.B.A. No.742 of 2018, Criminal Application (APPP) No.850 of 2018 does not survive and the same is accordingly disposed off.
