The above Civil Application has been filed for condonation of delay of 1 year and 30 days in filing the First Appeal. The reasons for the same are mentioned in the Civil Application and especially in paragraphs 6 and 7 of the Civil Application. The grounds made out in the Civil Application are questioned by the Respondent by filing affidavit in reply dated 20.06.2016. The said reasons can be said to be the plausible reasons for the said delay of 1 year and 30 days occurring in filing the First Appeal. With a view to give an opportunity to the Applicants/Applicants to BGP.

(11)-CAF-2638-16.doc prosecute the above First Appeal on merits, the above Civil Application is allowed. Resultantly, the delay of 1 year and 30 days in filing the First Appeal stands condoned. The Applicants to pay costs of Rs.5000/- to the Respondent within one week from date. List the First Appeal for admission after two weeks i.e. on 13.07.2016.
