DATED : 15.03.2024 P.C. :- The petitioner is charge-sheeted for offences under Sections 379, 501 of the Indian Penal Code and Sections 43A, 66C of the Information Technology Act vide Crime No. 25 of 2020 registered with Malad Polcie Station.

The First Information Report was registered at the instance of respondent No. 3 on 18.01.2020 alleging that some unknown person had hacked user ID and password of Facebook account of the complainant and posted defamatory statement alongwith the photograph of film personality. 3.
It is submitted that parties have settled the dispute. The 1 / 3
complainant has no objection for quashing the impugned charge-sheet.

Respondent No. 3/complainant is present in the Court. The complainant is represented by the Advocate. The complainant has expressed his consent for quashing the proceedings. He has filed the afodavit stating that consent terms were executed between him and the accused. The complainant has agreed to withdraw all the allegations against the accused and not have any objection for the accused obtaining any relied from the competent Court in respect to the FIR bearing Crime No. 25 of 2020. He has no objection for quashing the said FIR and the proceedings arising out of the said FIR. The afodavit filed by respondent No. 3 contains memorandum of understanding executed between the complainant and the accused.

Since the parties have resolved the dispute and complainant has no objection for quashing the impugned proceedings, relief sought in this petition can be granted.
ORDER
(i) Writ Petition is allowed.

(ii) The proceeding in CC No. 2401810/PW/2021 pending before the Court of Metropolitan Magistrate,Borivali arising out of FIR dated 18.01.2020 vide vide Crime No. 25 of 2020 registered with Malad Police Station for offences under Sections 379, 501 of the Indian Penal Code and Sections 43A, 66C of the Information Technology Act are quashed and set aside. (iii) The petitioner shall pay cost of Rs. 15,000/- to the Central Police Welfare Fund, Director General of Police, Maharashtra State, Mumbai.
(iv) The details of the bank account for payment of cost are as under :
