By this petition under Article 226 of the Constitution of India, the Petitioner is seeking direction against the Respondents and, particularly, against Respondent No.3 to recheck / recount the marks of the Petitioner secured in the examination conducted for the post of 'Staff Nurse'(Pvt). pursuant to the advertisement dated 22nd February, 2019. 3.

It is the case of the Petitioner that actually he secured 148 marks and whereas in his result, it is shown 146 marks only. Advocate for the Petitioner submits that to that effect he has submitted his application dated 29th April, 2021 to Respondent NO.3 to recheck his marks. But, till today, Petitioner's application is not decided by the Respondents. V.A. Tikam 1/2

The Learned AGP submits that if time is granted, they will decide the Petitioner's application immediately. 5.

Considering this fact and as the Petitioner's application dated 29th April, 2021 is pending, the following order is passed:

ORDER

(a) Respondent No.3 is directed to decide the Petitioner's application dated 29th April, 2021 on its own merits immediately, in any case, on or before 18th May, 2021 and communicate the result to the Petitioner in writing.

(b) With this direction Writ Petition is disposed of accordingly.

(c) No order as to costs.
