DATE: JUNE 07, 2022 P.C.:- 1] In response to the Court's query, Mr. Kate learned Counsel for the Petitioners fairly concedes that parties are already litigating before the Civil Court in a suit for partition being Special Civil Suit No.9 of 2013. The property which is referred to in the order impugned is informed to be the subject matter of the said suit. 2] In that view of the matter, Petition stands disposed of. Needless to clarify that parties shall be governed by outcome of the Special Civil Suit for partition.
