Mr.Khandeparkar, learned Advocate appearing for the Petitioner states that the Petitioner will be satisfied if conditional NOC is granted by the society to the effect that if all required permissions from the relevant authorities are obtained by the Petitioner then the society will have no objection for user of shop premises of the Petitioner for conducting Dominos Pizza outlet.

Mr.Kukreja, learned Advocate for Respondent-society states that as per his instructions the society is ready and willing to give necessary no objection to the Petitioner in the above manner. The statement of learned Counsel for the Respondent No.4 made on behalf of Respondent No.4 is accepted.

In view of statement of Respondent No.4 nothing survives in the Writ Petition. However, Respondent No.4 is directed to issue necessary NOC as per their statement within a period of two weeks from today. 4.
