Learned Senior Counsel for the applicant submits that he has instructions to withdraw the application. He has tendered a letter addressed SQ Pathan 1/2

aba.717.17.5.doc by the applicant to the Advocate on record. The said letter is taken on record and marked `X' for identification. Learned Senior Counsel states that the applicant will surrender before the appropriate Authority within one week from today, after giving notice to the Investigating Officer of the date and time of surrender. The said statement is accepted. 2.

Accordingly, the application is dismissed as withdrawn. 3.

It is made clear that if an application for regular bail is filed, the same shall be considered on its own merits. 4.

In view of the above, intervention application being Criminal Application No. 546 of 2017 does not survive. The same is accordingly disposed of.
