I have heard the learned counsel for the parties as well as the Court Receiver.

The appeal is disposed of in terms of the consent terms dated 6 September 2021.

The Court Receiver is discharged without passing account. The amount deposited shall be returned to the respondents after recovery the costs, charges and expenses. 6.

Court Receiver Report No.97 of 2009 is disposed of. Decree be drawn accordingly.
