The orders impugned are the ones passed in the RTS proceedings in respect of mutation entry being No.8073. In my view, it would be appropriate if the Petitioner adopt appropriate civil proceedings or take such defences as are available to him in the suit already filed by the Respondent No.1. If any such proceedings are filed or defences taken, needless to state that the observations made by the Revenue Authorities in the RTS proceedings would not come in the way of the Petitioner in prosecuting the said proceedings or the suit. With the aforesaid clarification, the Writ Petition is disposed of. Needless to state that the entries would be subject to the result of the civil proceedings.
