Heard Ms.Zehra Charania, learned counsel for the applicant. Heard Mrs.Uma Palsuledesai, learned counsel for respondent no.1, who, on instructions, submits that the applicant has been attending the office of the NCB as directed. The learned counsel for the respondent no.1, however, submits that the coaccused who has been released on bail in this case, has absconded, and therefore, the condition imposed upon the applicant may not be relaxed.
It is however pointed out by the learned counsel for the applicant that the co-accused who absconded was a British National.
Tilak 2/2 (9)APPA-554-15 Considering all the relevant aspects of the matter, I am inclined to allow the application.
Application is allowed.
The condition requiring the applicant to report to NCB office of Ballard Pier once in a week, is cancelled. Instead, the applicant shall report to the NCB office at Ballard Pier once in a month i.e. on the first Monday of each calendar month. Application is disposed of accordingly.
