IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.7832 OF 2016 Santosh Iyer ..Petitioner Vs.

Mrs.Anita Santosh Iyer @ Anita Subramanian ..Respondent ----- Mr.Prathamesh Kamat with Ms.Aditi Pawar i/b. Ms.Kavita Chandan for Petitioner.

----- CORAM :

G.S. KULKARNI, J.

DATE : 19th DECEMBER, 2017 P.C.:

After hearing learned Counsel for the petitioner, I am not inclined to interfere in the impugned order. The amount of maintenance which has been granted by the impugned order is Rs.20,000/- which does not appear to be unreasonable considering the facts and circumstances of the case. However, learned Counsel for the petitioner would contend that the petitioner intends to seek modification in the impugned order by placing further material/documents on record before the Trial Court. If that be so, then the petitioner cannot be prevented from making such an application as permissible in law.

2.

Needless to observe that if such an application is made, all contentions of the parties on merits are expressly kept open.

904-wp 7832-16 Learned Trial Judge shall consider the application on its own merits and without being influenced by the impugned order. 3.

Writ Petition is accordingly disposed of. No costs. [G.S. KULKARNI, J.]
