This application is preferred by claimant for condonation of 89 days delay in filing First Appeal challenging the judgment and award dated 29.8.2012 passed by Commissioner for Workmen's Compensation and Judge, 2nd Labour Court, Mumbai in Application (WCA) No.256/B-47/2008. Considering the submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case for Mohite 1/2

A) Civil Application is allowed in terms of prayer clause (a) which read thus:
"(a) The delay of 89 days for filing the appeal beyond the period of limitation is condoned."
B) Rule made absolute accordingly.
