Versus
The State of Maharashtra and others ..Respondents Mr. Mahadeo B. Ghule, Advocate for the Petitioner. Ms. Shruti Vyas, "B" Panel Counsel for Respondent No.1. CORAM : B. R. GAVAI & DAMA SESHADRI NAIDU, JJ.
DATE : 25th MARCH, 2019 P.C.
1] The present Petition has been filed by the Petitioner alleging non-compliance of the order dated 8th June 2015. 2] No doubt, belatedly the Respondent authority has in fact decided the representation of the Petitioner vide order dated 16th April 2017. By the said order, the claim of the Petitioner has been rejected by giving reasons therein.
3] Learned counsel for the Petitioner submits that the rejection of the claim itself amounts to contempt. BGP. 1 of 2
(20)-CP-227-17.doc.
4] With great respect to the submission advanced by the learned counsel for the Petitioner, what was directed is to decide the representation of the Petitioner. There was no direction to grant the representation of the Petitioner. If in view of the Petitioner, the order dated 16th April 2017 is not in accordance with law, nothing precludes the Petitioner to challenge the same. The Contempt Petition stands disposed of.
