By an Order dated 27.4.2018 the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates to join the process of investigation.

Heard the learned counsel for the applicant and the learned APP. Perused the record of investigation. 3.

As noted earlier in Order dated 27.4.2018, the applicant by giving assurance to marry with the prosecutrix had physical relations with her who was aged about 21 years, however, subsequently he resiled from the said Page-1/2

The record of investigation indicates that, the applicant had reported to the Investigation Officer on stipulated dates and has joined the process of investigation. It further appears that the medical examination of the applicant has been conducted and the applicant has cooperated in the process of investigation. 5.

After perusing the record, this Court is of the view that, for further investigation of the present crime, the custodial interrogation of the applicant is not necessary. 6.

In view thereof, the interim relief granted by Order dated 27.4.2018 is hereby confirmed. However, the condition to attend the Investigating Officer is waived. 7.
