This is one more petition wherein a simplicitor direction is sought to expedite the proceedings pending before the learned Civil Judge, Senior Division. Apart from the maintainability and the propriety of issuing writ under Article 226 of the Constitution of India to a civil Court, we are not inclined to issue such a direction in a routine manner. The Petitioner has not placed on record any data as to what is the pendency of cases before the learned Civil Judge. Such simplicitor direction for out of turn hearing without reference to the pendency before the learned Civil Judge is prejudicial to those who are waiting and who may have urgent matters, and do not have means to approach this Court.

Further, the learned Civil Judge is also bounden to implement the general directions issued by this Court to dispose of the 5 year old and older pending cases on a priority basis.
