The learned counsel for the appellant submits that Advocate Mrs. Suhasini Mutalik filed vakalatnama on behalf of appellant through Power of Attorney holder. Later on, the Appellant himself has given vakalatnama in his favour and same is accepted by the office.

The learned counsel for the appellant submits that the Appellant Mr. Baban Devram Dhumal is present in the Court. He further submits that he received instructions from his client to withdraw the 1/3

present Second Appeal, in view of settlement out of the court. To that effect, he has given in writing on farad. Same is accepted.

Second Appeal stands dismissed as withdrawn. No order as to costs.

In view of withdrawal of Appeal, nothing survives in the Civil Application. Hence, same stands dismissed as infructuous.
