By this Civil Application, applicant is seeking condonation of 60 days delay in filing First Appeal challenging the judgment and award dated 25.09.2017 passed by Motor Accident Claim Tribunal, Thane in Motor S.C. Magar 1/2

45.caf.3308.2018.doc Accident Claim Petition No.828 of 2007 holding that the respondent/original claimants are entitled for compensation to the extent of Rs.1,73,850/- with 9% interest.

Considering the submissions made by learned Counsel for the applicant, averments made in Civil Application, I am satisfied that the applicant has made out case for allowing this Civil Application. Hence, following order :- a) Delay in filing First Appeal is condoned.

b) Civil Application stands disposed of accordingly.

c) No order as to costs.
