By this Application, filed under Section 439 of Cr.P.C., the State has sought cancellation of pre-arrest bail granted by this Court in Anticipatory Bail Application No.690 of 2016. 2.

The Applicant had filed the said Application under Section 438 of Cr.P.C. apprehending his arrest in C.R.No.20/2016 registered with Talasari Police Station, Thane for offences under Sections 186, 333, 353, 395, 397, 504 and 506 of the Indian Penal Code. Learned APP states that subsequent to the order dated 26/08/2016 in Anticipatory Bail Application No.690/2016, the provisions of Maharashtra Control of Organized Crime (MCOC) Act, 1999 were invoked in view of which 1/2

P.H. Jayani 11 APPLN227.2017.doc the Application was filed for cancellation of bail. He further states that the permission to invoke the provisions of MCOC Act has been refused on 13/01/2021. He states that charge sheet has been filed only in respect of offences under Indian Penal Code. In the light of said statement, the grounds for cancellation of bail do not survive. Hence, the Application is dismissed.
