Heard learned Counsel for the parties.
This application is preferred by claimant for allowing them to withdraw sum of Rs.4,50,000/- deposited by the Appellant.
The learned counsel for the applicant submits that this Court by order dated 09.09.2009 in Civil Application No. 1956 of 2009 expedited the hearing of First Appeal. He submits that First Appeal is ready for hearing. He submits that he does not want to press the present Civil Application for withdrawal of amount. He submits that instead of that this Hon'ble Court be pleased to direct the office to place First Appeal No. 411 of 2006 on board for final hearing.
