1] The learned APP on instructions of the Officer from ACB Raigad state that in respect of the property acquired by the Petitioner, an open enquiry is in progress, in terms of the directions issued by the Director General.

2] This is the specific reason, advanced to deny the relief sought in the Application, which seek return of the cash amount of Rs.16,00,000/- which was found during the house search.

Since the investigation is not yet complete and charge-sheet is yet to be filed, I do not find any legal infirmity in the impugned order passed by the Special Judge, in refusing to entertain the Application. Upholding the said order, Writ Petition is dismissed. [BHARATI DANGRE, J] 1/1
