Heard learned counsel for the applicant and learned APP for the non-applicant.

Perused the F.I.R.. Considering the nature of the allegation and having regard to the fact that the applicant's custodial interrogation is already over, further detention of the applicant cannot be justified. There are no criminal antecedents. In that view of the matter, following order is passed :

(i) The applicant be released on bail in Crime No. 159 of 2021, punishable under Sections 354-A of Indian Penal Code and Section 8, 12 of POCSO Act, registered with Pant Nagar Police Station, Mumbai, upon furnishing P.R. bond of Rs.25,000/- with one or more sureties in the like amount. (ii) The applicant is permitted to furnish solvency certificate in eight weeks from today. Till then, the applicant be released on cash bail.

(iii)The applicant shall attend investigation officer on every Thursday between 10.00 to 12.00 hours till filing of the charge-sheet.

(iv)The applicant shall not influence the prosecution witnesses or tamper with the evidence;

(v) Two consecutive absence of the applicant during the course of trial and/or his non co-operation in

3/3 disposal of the trial will entail the concerned Court to take out the proceedings for cancellation of bail of the applicants.

The application is allowed and stands disposed of in above terms.
