This is a second Bail Application as the first Bail Application No.2518 of 2014 was rejected by this Court on 25.6.2015. The applicant/accused is facing charges under sections 307, 201, 120B r/w 34 of the Indian Penal Code, under sections 3, 25, 27 of the Arms Act and under sections 3(1)(ii), 3(2), 3(4) of the Maharashtra Control of Organised Crime Act.

The learned Counsel for the applicant/accused submits that the trial is going on and the prosecution is not giving the exact idea as to how many witnesses they are going to examine before the Sessions Court.

The learned Public Prosecutor informs that 20 witnesses have been examined till today.

From the submissions of the learned Counsel for the applicant/accused, no change of circumstance is made out. If at all, the defence counsel has any grievance about the schedule and program of examination of the witnesses, then, he should move the trial Court.

Bail Application is rejected. However, the trial Court may endeavour to expedite the matter.
