1] Applicant, after arrest on 04/09/2018, is seeking regular bail in C.R. No. 186/2018 registered with Wada Police Station for offence punishable under Sections 120(B), 395 of the Indian Penal Code and under Sections 3, 25 of Indian Arms Act.

2] Maximum punishment provided is for 10 years and applicant has already suffered incarceration for more than three years. 1/2

24.27.21 BA.doc 3] Other similarly placed accused Malkhan Singh was already ordered to be released on bail vide order dated 31/03/2021. Though there is recovery of article from the applicant who was absconding for almost one year, in the aforesaid background, case for grant of bail, in my opinion, is made out.

(i) Applicant be released on bail in C.R. No. 186/2018 registered with Wada Police Station for offence punishable under Sections 120(B), 395 of the Indian Penal Code and under Sections 3, 25 of Indian Arms Act upon furnishing P.R. bond in the sum of Rs. 25,000/- with one or two local sureties in the like amount.

(ii) Applicant shall neither influence witnesses in any manner nor tamper with evidence.

(iii) Applicant shall furnish his contact details, place of residence to the Investigating Officer at the time of his release.
