IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 9996 OF 2016 Shri. Subhash Ramchandra Jadhav

...Petitioner

V/s.

The State of Maharashtra & Ors

...Respondents

Mr. A.M. Kulkarni for the Petitioner.

Mr. J.A. Madane, AGP for the Respondent No.1. Mr. Kedar Lad for Respondent No.3.

CORAM : R.D. DHANUKA, J.

DATE : 31ST JANUARY, 2018.

P.C. :- 1.

By this petition filed under Article 226 & 227 of the Constitution of India, the petitioner has impugned the order dated 06th April, 2016 passed by the Divisional Joint Registrar, Kolhapur Division rejecting the application filed by petitioner, on the ground that there was no order of Subordinate Officer which could have been impugned in the said revision application.

2.

However, in the said order the Divisional Authority has made it clear that in respect of settlement of loan, the liquidator is at liberty to settle loan as per the policy adopted by him of recovering the dues as per schemes sanctioned by the registrar.

910-WP-9996-2016 3.

The petitioner is not agreeable to deposit any amount in this court or with the respondent no.3 to show his bonafides though submits that one time settlement proposal made by the petitioner ought to have been considered.

4.

I am thus not inclined to interfere in the order passed by the Divisional Authority. Writ Petition is accordingly dismissed. No order as to costs.
