This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No.148 of 2021 registered at Lohmarg, Pune Police Station for the ofence punishable under Section 489(D) read with 34 of the Indian Penal Code (IPC).

On 4 September 2021, the Railway Police had apprehended the co-accused Jaypal Waghmare and he was found in possession of unfnished counterfeit currency notes of Rs.2000 denomination and certain other incriminating material to manufacture counterfeit currency notes. The said co-accused was interrogated and he had disclosed that the said incriminating material was 1/3

given to him by one Mani S. Seduraman, resident of Madhurai, State of Tamil Nadu.

It appears that request letter was sent to Tamil Nadu State Police to arrest Mani S. Seduraman and pursuant to the said request the present applicant was arrested.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The learned counsel for the applicant submits that the name of the applicant is Rajaram M. Mutthuviran. It is submitted that there is no material on record to connect the accused with the alleged crime. It is submitted that the applicant was government servant. It is further submitted that no incriminating material was found from the possession of the present applicant. 7.

Admittedly, no incriminating material came to be recovered at the instance of the applicant. There is no material to connect the present applicant with alleged crime. I am therefore, inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] Bail Application is allowed.

B] The applicant be released on bail in Crime No.148 of 2021 registered at Lohmarg, Pune Police Station for the ofence punishable under Section 489(D) read with 34 of 2/3

the IPC on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
