State Of Maharashtra ... Respondent Mr. Vinayak V. Katti Appointed Advocate for Petitioner. Ms. S. D. Shinde APP, for Respondent-State.
CORAM : A.S. GADKARI AND PRAKASH D. NAIK, JJ.
DATE : 29th NOVEMBER, 2022.
P.C. :
1.
Heard Mr. Katti, learned Advocate appointed to represent Petitioner.
2.
By the present Petition received through Jail, Petitioner has impugned Orders dated 17th September, 2018 passed by Competent Authority rejecting the furlough leave Application and dated 6th February, 2019 of the Appellate Authority confirming the Order passed by the Competent Authority for the year 2019. Record indicates that, apart from the adverse report submitted by local police, when Petitioner was released on furlough on 20th October, 2003 he reported to Jail Authority on 19th October, 2010, late by 2386 days and therefore his name has been permanently removed from the register of remission. 3.
According to us, this ground alone is sufficient for not entertaining the Application of Petitioner for furlough leave and both the 1/2
CAJ 18-Wp-1992-2019.odt Authorities have not committed any error while passing impugned Orders. 4.
Petition is devoid of merits and is accordingly dismissed. 5.
It is however made clear that, Petitioner will be at liberty to file fresh Application for furlough leave as and when his right to file said Application accrues.
