IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO. 2530 OF 1996 WITH CIVIL APPLICATION (ST) NO. 35694 OF 2002 IN FIRST APPEAL (ST) NO. 17318 OF 1995 The State of Maharashtra ...Applicant

Versus

Kalu Raoji Gangurde

...Respondent

Mr AA Palkar, AGP for the Applicant/State.

CORAM: G.S. PATEL, J DATED:

26th July 2017 PC:- 1.

The Civil Application for condonation of delay has abated against Respondent Nos.1A to 1C. The amount involved is Rs.13,000/-.

2.

In my view it is not worth the trouble to the Government to pursue this appeal in respect of so negligible an amount. Far more will be spent in attempting service and hearing, apart from placing a 26th July 2017

4-CA2530-96-.DOC burden on a Government's resources and the Court's time. The Appeal will have to be dismissed on that limited aspect. 3.

There is no examination of the merits. This order is not to be construed as the Court having accepted or affirmed the rate awarded by the Reference Court or as the Court having accepted the rate as being applicable to other lands in the area. 4.

With these clarifications the Appeal is dismissed. In view of the dismissal of the Appeal, the Civil Applications are disposed of as infructuous.
