1) The applicant is apprehending arrest in CR No.207/2017 dated 13.4.2017 registered with Andheri Police Station, Mumbai under Section354 and 354A of the Indian Penal Code.
2) The first information report is lodged by Smt. Soni Gutola alleging that on 13.4.2017 the applicant abused her in filthy language.
2) I have perused the record of the investigation. It appears from the record that the other lady witness who was present at the time of incident is not supporting the version of the first informant and is silent about the alleged abuses hurled by the applicant. In view thereof the applicant has made out a case for his pre arrest bail.
3) Hence, the following order.
a) In the event of arrest of the applicant in CR No.207/2017 dated 13.4.2017 registered with Andheri Police
2 /2ABA-735-17-909 Mumbai, the applicant shall be released on bail on his furnishing PR bond of Rs.25,0000/ with one or two solvent local sureties in the like amount.
b) The applicant shall not tamper with the evidence and/or influence the prosecution witnesses.
c) The applicant shall attend the Investigation Officer as and when called for between 11.00 a.m. to 1.00p.m. till the submission of the final report and/or charge sheet. d) It is needless to mention that before calling the applicant in Police Station the Investigation Officer shall issue notice under Section 160 of the Cr.P.C. stating the date and time.
e) Application is disposed off.
