Challenge in the petition is to the order dated 4/09/2020 passed by Respondent No. 3/Education Officer. The petitioners are questioning the reasoning as regards non-inclusion of D.Ed. in Category C of Schedule F of the Maharashtra Employees of Private Schools Rules, 1981. According to the learned Counsel for the petitioners aforesaid observations are without any basis. He would urge that as draft rules are already furnished, there is likelihood of 1/2

31. WP.4648.2021doc inclusion of the D.Ed. Course in Category C of Schedule F and same is under consideration of the State Government.

If we appreciate aforesaid contention, it can be noticed that the observations which are made in the impugned order by Respondent No. 3 are in accordance with Maharashtra Employees of Private Schools Rules. In case in future said Category C of Schedule F is amended, the option is kept open to the petitioners to re-agitate their claim.

In this background prayer for withdrawal of the petition is made.
