This is an application under Section 378(4) of the Cr.P.C. for leave to file Appeal against the Judgment and Order dated 08.03.2017 passed by the learned Addl. Chief Metropolitan Magistrate, 8th Court, Esplanade, Mumbai in C.C. No. 434/SS/2005, thereby acquitting the Respondent No.1 under Section 500 of the Indian Penal Code.

After hearing the learned Counsel for Applicant at length, when this Court was not inclined to interfere with the impugned Judgment and Order, the learned Counsel on instructions from the Applicant who is personally present in the Court seeks leave to withdraw the application unconditionally. Leave granted.

Application is dismissed as withdrawn.
