P.C.:- This is an Application under Section 439 of the Code of Criminal Procedure for bail in CR No. 5 of 2018 dated 6th August, 2018 registered with Juhu Police Station, Mumbai under Sections 406, 420 read with Section 34 of the Indian Penal Code. Heard the learned counsel for the Applicant, the learned counsel for the first informant and the learned APP. Perused the charge-sheet.

During the course of arguments, the learned counsel for the Applicant, on instructions, submitted that, the Applicant without 1/3

ssm 2 52-ba1195.19.doc prejudice to his rights and contentions and with a view to prove his bonafide will deposit a sum of Rs.29,87,492/- in the Registry of this Court within a period of one week from the date on which the present Order is uploaded on High Court Website. The said statement is accepted.

In view thereof and without going into the merits of the matter, the Applicant can be released on bail. Hence the following ordera) The Applicant be released on bail in CR No. 5 of 2018 dated 6th August, 2018 registered with Juhu Police Station, Mumbai on his furnishing PR bond of Rs.15,000/- with one or two local sureties in the like amount.

b) It is made clear that, the deposit of the said amount of Rs.29,87,492/- in the Registry of this Court shall be condition precedent for the actual release of the Applicant from the Jail.

c) After his release from Jail, the Applicant shall attend all the dates before the Trial Court unless 2/3

d) Any two consecutive defaults in complying with the afore-stated condition will attract the provisions of cancellation of bail.
