Heard the learned counsel for the Petitioner and learned APP for State.

Admittedly, the petitioner has fled two petitions for the same reliefs, which were rejected by this Court. 3.

We have carefully perused the past record/conduct of the petitioner. When the Petitioner was released on 24th August, 1995, on furlough, he did not report back to the prison authority on completion of furlough. He illegally overstayed for more than 6362 Bhagyawant Punde

2/2 15-WP-2665-2021.doc days i.e. more than 17 years and he was arrested and brought back to the prison. By any stretch of imagination such illegal overstay of the petitioner cannot be countenanced and no indulgence can be shown by exercising our discretion in favour of such convict. 4.
