Advocate Mr. Nitin Vhatkar, for Appellant was present before the Registrar and he submitted that this Interim Application (for Restoration) No. 4621 of 2023 in FCA No. 40 of 2017 has been filed due to oversight. He submitted that there is another connected Interim Application (for Restoration) No.

4622 of 2023 in FCA No. 42 of 2017 filed due to oversight for the same purpose and office remarks in both the Applications are same (i.e. objections in both FCA have been already removed by Ld. Adv. for Appellant). But Interim Application No. 4622 of 2023 was inadvertently not taken on today's board. Both the FCA No. 40 of 2017 and FCA No. 42 of 2017 are pending. Therefore there is no need to file Applications for Restoration of both FCA. He further submitted that both these Interim Applications may be disposed off. In this situation, both these Interim Appllication Nos. 4621 of 2023 and Interim Application No. 4622 of 2023 does not survive and disposed off.
