By an order dated 30 April 2015, the petitioner was permitted to serve the respondents. Learned counsel for the petitioner tenders an affidavit dated 6 May 2015 placing on record that the respondent No.1 has refused service. The civil application is taken out for extension of time to file

bsb 2 CAW1112.15.doc an additional affidavit of evidence. By an order dated 3 February 2015 the same was directed to be filed within three weeks. The learned Small Causes Court Judge has refused extension on the ground that the time be sought from this Court. Considering the facts and circumstances of the case, the time to file an additional affidavit of evidence is extended by a period of three weeks from today.

The civil application is accordingly disposed of in terms of prayer clauses (a) and (b).
